Terms of Service

Please read these Terms of Service ("Terms") carefully before using FRESKNOW ("the Platform," "we," "us," or "our"). By creating an account or accessing the Platform in any way, you agree to be bound by these Terms. If you do not agree, do not use FRESKNOW.

1. Who We Are

FRESKNOW is a private, invitation-only online community platform for people who live in, work in, or are meaningfully connected to the Fresno, California area. The Platform is operated by an individual owner based in Fresno, California.

2. Eligibility

• You must be at least 18 years of age to create an account.
• You must be a real person using your own identity. Fake, impersonated, or bot accounts are strictly prohibited.
• You must be a resident of, work in, or have a genuine connection to the greater Fresno, California area.
• You must receive a valid invitation from an existing member to register.
• By creating an account, you confirm that all information you provide is accurate and truthful.

3. Invitation and Vouching System

FRESKNOW operates on an invite-and-vouch membership model. New members must receive an invitation and be vouched for by existing community members before their account is fully activated. Existing members who vouch for others take on a degree of responsibility for the conduct of those they vouch for. Abuse of the invitation system may result in suspension of both the inviter and invitee.

4. Account Responsibilities

• You are responsible for maintaining the security and confidentiality of your account credentials.
• You may not share your account with others or allow anyone else to access it.
• You must notify us immediately of any unauthorized use of your account.
• You are responsible for all activity that occurs under your account.

5. Community Standards and Prohibited Conduct

FRESKNOW is a curated community built on trust, respect, and real local identity. The following are strictly prohibited:

• Harassment, bullying, intimidation, or threats directed at any person
• Hate speech, discrimination, or content that demeans individuals based on race, ethnicity, gender, sexual orientation, religion, disability, or national origin
• Sharing false, misleading, or defamatory information about any person or business
• Spam, unsolicited solicitations, or commercial advertising without permission
• Posting content that violates any applicable law, including but not limited to California state law and federal law
• Sharing another person's private information without their consent ("doxing")
• Impersonating any person, business, or entity
• Attempting to access, interfere with, or disrupt the Platform or its servers
• Creating multiple accounts or evading a suspension or ban

6. User-Generated Content

By posting content on FRESKNOW (including posts, replies, event listings, articles, and profile information), you grant FRESKNOW a non-exclusive, royalty-free, worldwide license to display and distribute that content within the Platform. You retain ownership of your content.

You are solely responsible for the content you post. FRESKNOW does not endorse, verify, or take responsibility for user-generated content. We reserve the right to remove any content that violates these Terms or our community standards without notice.

7. Events

FRESKNOW may feature community event listings. We do not organize, host, or endorse any listed events. Attendance at events listed on the Platform is entirely at your own risk. FRESKNOW is not responsible for anything that occurs at third-party events, including personal injury, property damage, or any other harm.

8. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

9. Disclaimer of Warranties

FRESKNOW is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. Your use of the Platform is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by California law, FRESKNOW and its owner(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or personal injury — arising out of or in connection with your use of the Platform or any content posted by other users, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the Platform shall not exceed fifty dollars ($50.00).

11. Indemnification

You agree to defend, indemnify, and hold harmless FRESKNOW and its owner(s) from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your content; or (d) your violation of any third party's rights.

12. Account Termination

We reserve the right to suspend or permanently terminate any account at any time, with or without notice, for any violation of these Terms or for conduct we determine to be harmful to the community. You may also delete your account at any time by contacting us.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Fresno County, California, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify active members of material changes.
